Azurance provides our Website, content, products and services offered on or through our Website (collectively, the “Services”), to you subject to the following Terms of Use (“TOU”). Your use of the Services in whole or in part constitutes your binding acceptance of these TOU. If you do not agree to these TOU, you should not use the Services. Some Services may be subject to additional posted rules, policies and terms.

The documents and graphics published on this Website could include technical inaccuracies or typographical errors. Questions or problems regarding this Website should be directed to support@azurance.com. Azurance and/or its respective suppliers may make improvements and/or changes in the product(s) and/or the program(s) described herein at any time.

Azurance does not want to receive confidential or proprietary information from you through our Website. Please note that any information or material sent to Azurance will be deemed NOT to be confidential. By sending Azurance any information or material, you grand Azurance an unrestricted, irrevocable license to use, reproduce, display, perform, modify, transmit and distribute those materials or information, and you also agree that Azurance is free to use any ideas, concepts, know-how or techniques that you send to Azurance for any purpose. However, we will not release your name or otherwise publicise the fact that you submitted materials or other information to us unless:

1. We obtain your permission to use your name;
2. We first notify you that the materials or other information you submit to a particular part of this site will be published or otherwise used with your name on it; or

Description of the Services

Azurance provides you with access to a variety of resources, including developer tools, download areas, communication forums and product information (collectively, the “Services”). The Services, including any updates, enhancements, new features, and/or the addition of any new web properties are subject to the TOU.

Member Account, Password and Security

If any of the Services require you to open an account, you must complete the registration process by providing us with up-to-date, complete, and accurate information as prompted by the applicable registration form. You will also choose a password and a username. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Azurance immediately of any unauthorised use of your account or any other breach of security. Azurance will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Azurance or another party due to someone else using your account or password. You may not use anyone else’s account at any time, without the permission of the account holder.

Resale of Services

You agree not to reproduce, duplicate, copy, license, sublicense, sell, resell or exploit for any commercial purpose, any portion of the Services, or access to the Services without Azurance's prior written, explicit and express permission.  In addition, you may not use, modify, copy, and/or distribute any redistribution software unless you expressly agree to and comply with certain additional terms contained in the Services Provider Use Rights ("SPUR") applicable to Azurance, which terms are available from the Microsoft's SPLA website.
